Supplemental Terms - Device Purchases
Verifone offers various Devices for purchase. The fees for purchasing any Devices are set forth on the applicable Order Form.
1. ORDER PROCESS; SHIPMENT.
(a) Orders. Verifone will make available to you information regarding the status of your accepted Device orders, including the dates on which Verifone expects the Devices to become available for shipment to or pickup by you (the “Availability Date”), either upon request or via one or more Verifone portals.
(b) Delivery and Shipment. Verifone will arrange for delivery of Devices at your cost and expense and title and risk of loss will transfer to you at the time of delivery by Verifone to the relevant carrier for shipment. You shall be deemed to have accepted the Devices upon the date title to such Devices passes to you. Verifone shall be entitled to charge you for the shipment of Devices. While Verifone shall make reasonable efforts to meet any acknowledged delivery dates, these delivery dates remain estimates, and Verifone shall not be liable to you for its failure to meet any such delivery dates. Verifone and you agree that time is not of the essence.
2. WARRANTY.
(a) Standard Warranty. Verifone provides its standard warranty for purchased Devices. Refer to Standard Warranty Terms for Verifone Payment Devices.
(b) Warranty Period. The standard warranty period for each Device is 12 months and will begin to run from the date such Device is shipped from Verifone’s facility or the date title to such Device passes to you, whichever date is earlier (such period referred to herein as the “Warranty Period”). Verifone reserves the right to change a Warranty Period for a specific Device; provided that only orders placed after the effective date of such change shall be affected.
